This Beta Privacy Notice (this “Notice”) describes how Zyphra Technologies, Inc. This Notice supplements the Zyphra Privacy Policy. The Privacy Policy continues to apply. If this Notice conflicts with the Privacy Policy, this Notice controls solely with respect to personal information processed through the Beta and only to the extent of the conflict, except that a provision affording greater protection to personal information will continue to apply. Nothing in this Notice expands Zyphra’s permitted use of information obtained through Google APIs or reduces any protection applicable to Google user data.

Zyphra does not use Beta personal information for targeted advertising. Zyphra will not use Beta content to train a general-purpose artificial intelligence or machine learning model unless Zyphra provides additional notice and obtains any consent required by applicable law. Zyphra may use Beta content to evaluate model performance and to develop safety, reliability, and product improvements for the Beta Services.
3. Human Review
The Beta is an evaluation program. Authorized Zyphra personnel and contractors may review prompts, uploaded materials, outputs, feedback, and related logs when reasonably necessary to provide support, investigate errors, evaluate model behavior, improve safety or reliability, prevent abuse, or comply with law. Access is limited to personnel and contractors with a need to perform those functions and is subject to applicable confidentiality and security obligations.
4. How We Disclose Personal Information
Zyphra may disclose personal information collected through the Beta:

- to third-party services at the participant’s direction, including when the participant connects or instructs the Beta to interact with a third-party account;
- to professional advisors, auditors, insurers, financing sources, and transaction counterparties subject to appropriate confidentiality obligations;
- to law enforcement, regulators, courts, or other parties when Zyphra believes disclosure is required or appropriate to comply with law, protect rights or safety, or investigate misuse;
- in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction; and
- with the participant’s consent or at the participant’s direction.
Zyphra does not sell Beta personal information or disclose it for cross-context behavioral advertising.
5. Google User Data
If a participant connects a Google account, Zyphra’s access to and use of information received from Google APIs is governed by the permissions granted by the participant, Zyphra’s Privacy Policy and Google API disclosures, and the Google API Services User Data Policy, including the Limited Use requirements. Zyphra uses Google user data only to provide features the participant authorizes. Zyphra does not use Google user data for advertising or marketing and does not use Google user data to train general-purpose artificial intelligence or machine learning models without the participant’s explicit, informed consent. Any more protective provision applicable to Google user data will control.
6. Retention
Zyphra retains Beta personal information for as long as reasonably necessary to operate and evaluate the Beta, provide requested services, maintain security and integrity, resolve disputes, enforce agreements, and comply with legal obligations. Retention periods may vary based on the type of information, the nature and duration of the Beta, the participant’s account settings and instructions, operational requirements, and applicable law.
When Beta participation or an account ends, Zyphra may delete or de-identify Beta personal information in accordance with its retention practices, except where continued retention is reasonably necessary or legally required. Information may remain for a limited period in routine backups and security logs and will remain protected while retained. A participant may request deletion by contacting privacy@zyphra.com. Zyphra will process verified requests in accordance with applicable law and may retain information where an exception applies.
7. Participant Choices and Privacy Rights
Participants may choose not to provide optional information, but some Beta features may then be unavailable. Participants may disconnect third-party accounts through the Beta or the third party’s account settings. Depending on location and applicable law, participants may have rights to request access to, correction of, or deletion of personal information; receive a copy of personal information; object to or restrict certain processing; or appeal a decision concerning a privacy request. Requests may be submitted to privacy@zyphra.com. Zyphra may take reasonable steps to verify identity and authority before processing a request.
8. Sensitive and Third-Party Information
Unless Zyphra expressly authorizes otherwise in writing, participants should not submit confidential, sensitive, regulated, export-controlled, production, or mission-critical information through the Beta. Participants should not submit personal information about another person unless they have the right to do so and have provided any notice or obtained any consent required by law.
9. Security
Zyphra uses administrative, technical, and physical safeguards designed to protect personal information. No system or method of transmission or storage is completely secure, and Zyphra cannot guarantee absolute security. Participants are responsible for maintaining the confidentiality of their credentials and promptly notifying Zyphra of suspected unauthorized access.
10. Children
The Beta is not directed to children under 18, and Zyphra does not knowingly collect personal information from children under 18 through the Beta. If Zyphra learns that it has collected such information, it will take appropriate steps to delete it.
11. International Processing
Zyphra and its service providers may process personal information in the United States and other countries that may have different data protection laws than the participant’s country of residence. Where required, Zyphra uses appropriate safeguards for international transfers.
12. Changes to This Notice
Zyphra may update this Notice as the Beta develops or as its practices or legal obligations change. Zyphra will post the updated Notice and revise the “Last Updated” date.
