Acceptable Use Policy

This Acceptable Use Policy (also referred to as the “AUP”) applies to anyone who submits prompts, user data, or other information to Zyphra’s products or services (“Service Users”). If you have entered into the Zyphra Customer Agreement (the “Customer Agreement”), this AUP supplements and forms part of the Customer Agreement (the “Customer Agreement”). Zyphra may update this policy from time to time according to evolving risks, industry norms, and business needs. Any capitalized terms used but not defined herein are as defined in the Customer Agreement.
Service Users will not (and will not permit any other person or entity to):
Interfere with the operation of the Services, circumvent any access or usage restrictions, or conduct any security or vulnerability test of the Services;
Transmit any viruses or other harmful materials to or through the Services;
Take any action that risks harm to others or to the security, availability, or integrity of the Services;
Modify any Documentation except for Customer’s internal business purposes or publish any modified Documentation;
Change any of the interfaces described in the Documentation or extend any interfaces except as described in the Documentation;
Use the Services for high-stakes automated decision-making, including any use cases related to (a) legal interpretation, guidance, or decisions, (b) healthcare decisions, medical diagnosis, patient care, mental health, or other medical guidance, (c) health, life, property, disability, or other types of insurance underwriting, claims processing, or decisions, (d) financial decisions, (e) employment or housing eligibility, screening, or decisions.
Use the Services to process, transmit, or store any Sensitive Data, including protected health information, payment card information, financial account credentials, government-issued identification numbers, biometric identifiers, authentication credentials, or other information subject to heightened legal, regulatory, or security requirements, unless expressly authorized in writing by Zyphra.
Access, search, or otherwise use any portion of the Services (including Output) through the use of any engine, software, tool, agent, device, or mechanism (including spiders, robots, crawlers, and data mining tools) other than as expressly permitted in Company’s Documentation (e.g., via public API calls);
Use the Services to collect or generate personal information about another user or third party without consent;
Use the Services to engage in regulated activity without complying with applicable regulations, or promote or engage in any illegal activity, including the development or distribution of illegal or controlled substances, goods, or services or exploitation or harm of children;
Use the Services to generate pornographic or sexually explicit content;
Use the Services to upload or submit any Customer Data that could be deemed by a reasonable person to be objectionable, profane, indecent, harassing, threatening, embarrassing, hateful, or otherwise inappropriate;
Use the Services for deceptive or manipulative purposes, including to create deepfakes (or similarly deceptive Output), or performing any fraudulent activity including impersonating any person or entity, claiming a false affiliation or identity;
Evade any technical protections or other guardrails of the Services, including identity verification mechanisms;
Use the Services to participate in or facilitate gambling or lending activities;
Create multiple accounts for the purposes of taking advantage of any free or discounted usage;
Accessing any other account on the Services without permission;
Use the Services to engage in political activity, including any manipulation or attempted manipulation of governments or elections, or to spread misinformation or misleading information about a person, group, or entity;
Use the Services to create psychologically harmful content;
Facilitate or promote the exchange of illegal or highly regulated goods;
Use the Services to defraud, scam, spam, mislead, bully, harass, defame, discriminate based on protected attributes, sexualize children, or promote or incite violence or hatred, or facilitate any of these activities;
Misrepresent (1) the source of the Output, or (2) that Output is human-generated;
Publish benchmarks or performance information about the Services;
Provide any third party with access to any model provided through the Services other than Authorized Users via Zyphra’s APIs;
Conduct or facilitate the delivery or generation of spam or unauthorized or illegal use of automated dialing systems or the delivery of pre-recorded voice messages (also known as “robocalls”) without direct human intervention; or
use the Services or any content, data, information, or other materials made available through the Services (including Output) for purposes of, directly or indirectly, creating, testing, improving, training, or otherwise developing Customer's or any third party's artificial intelligence or machine learning models, systems, architecture, weights or related technology.
